Gypsy Law
Approximately one thousand years ago Gypsies, or Roma, left their native India. Today Gypsies can be found in countries throughout the world, their distinct culture still intact in spite of the intense persecution they have endured. This authoritative collection brings together leading Gypsy and non-Gypsy scholars to examine the Romani legal system, an autonomous body of law based on an oral tradition and existing alongside dominant national legal networks.<br /><br />For centuries the Roma have survived by using defensive strategies, especially the absolute exclusion of <i>gadje</i> (non-Gypsies) from their private lives, their values, and information about Romani language and social institutions. Sexuality, gender, and the body are fundamental to Gypsy law, with rules that govern being pure <i>(vujo)</i> or impure <i>(marime)</i>. Women play an important role in maintaining legal customs, having the power to sanction and to contaminate, but they are not directly involved in legal proceedings.<br /><br />These essays offer a comparative perspective on Romani legal procedures and identity, including topics such as the United States' criminalization of many aspects of Gypsy law, parallels between Jewish and Gypsy law, and legal distinctions between Romani communities. The contributors raise broad theoretical questions that transcend the specific Gypsy context and offer important insights into understanding oral legal traditions. Together they suggest a theoretical framework for explaining the coexistence of formal and informal law within a single legal system. They also highlight the ethical dilemmas encountered in comparative law research and definitions of «human rights.»
Natural State

Tensions of Empire
Starting with the premise that Europe was made by its imperial projects as much as colonial encounters were shaped by events and conflicts in Europe, the contributors to <i>Tensions of Empire</i> investigate metropolitan-colonial relationships from a new perspective. The fifteen essays demonstrate various ways in which «civilizing missions» in both metropolis and colony provided new sites for clarifying a bourgeois order. Focusing on the eighteenth, nineteenth, and early twentieth centuries, they show how new definitions of modernity and welfare were developed and how new discourses and practices of inclusion and exclusion were contested and worked out. The contributors argue that colonial studies can no longer be confined to the units of analysis on which it once relied; instead of being the study of «the colonized,» it must account for the shifting political terrain on which the very categories of colonized and colonizer have been shaped and patterned at different times.
What Is Enlightenment?
This collection contains the first English translations of a group of important eighteenth-century German essays that address the question, «What is Enlightenment?» The book also includes newly translated and newly written interpretive essays by leading historians and philosophers, which examine the origins of eighteenth-century debate on Enlightenment and explore its significance for the present.<br /><br />In recent years, critics from across the political and philosophical spectrum have condemned the Enlightenment for its complicity with any number of present-day social and cultural maladies. It has rarely been noticed, however, that at the end of the Enlightenment, German thinkers had already begun a scrutiny of their age so wide-ranging that there are few subsequent criticisms that had not been considered by the close of the eighteenth century. Among the concerns these essays address are the importance of freedom of expression, the relationship between faith and reason, and the responsibility of the Enlightenment for revolutions.<br /><br />Included are translations of works by such well-known figures as Immanuel Kant, Moses Mendelssohn, Johann Gottlieb Fichte, and Johann Georg Hamann, as well as essays by thinkers whose work is virtually unknown to American readers.
