Enacted in1975, the Education for All Handicapped Children Act – now called theIndividuals with Disabilities Education Act (IDEA) provides all children withthe right to a free and appropriate public education. On the face of it, theIDEA is a shining example of law’s democratizing impulse. But is that reallythe case? In Disabled Education, Ruth Colker digs deep beneath theIDEA’s surface and reveals that the IDEA contains flaws that were evident atthe time of its enactment that limit its effectiveness for poor and minoritychildren. Both anexpert in disability law and the mother of a child with a hearing impairment,Colker learned first-hand of the Act’s limitations when she embarked on a legalbattle to persuade her son’s school to accommodate his impairment. Colker wasable to devote the considerable resources of a middle-class lawyer to herstruggle and ultimately won, but she knew that the IDEA would not havebenefitted her son without her time-consuming and costly legal intervention.Her experience led her to investigate other cases, which confirmed hersuspicions that the IDEA best serves those with the resources to advocatestrongly for their children. The IDEAalso works only as well as the rest of the system does: struggling schools thatserve primarily poor students of color rarely have the funds to provideappropriate special education and related services to their students withdisabilities. Through a close examination of the historical evolution of theIDEA, the actual experiences of children who fought for their education incourt, and social science literature on the meaning of “learning disability,”Colker reveals the IDEA’s shortcomings, but also suggests ways in whichresources might be allocated more evenly along class lines.
Building on the insights of both disability studies and civil rights scholars, Mark C. Weber frames his examination of disability harassment on the premise that disabled people are members of a minority group that must negotiate an artificial yet often damaging environment of physical and attitudinal barriers. The book considers courts’ approaches to the problem of disability harassment, particularly the application of an analogy to race and sex harassment and the development of legal remedies and policy reforms under the Americans with Disabilities Act (ADA). While litigation under the ADA has addressed discrimination in public accommodations, employment, and education, Weber points out that the law has done little to combat disability harassment. He recommends that arguments based on unused provisions of the ADA should be developed and new legal remedies advanced to address the problem. Disability Harassment also draws on case law to explore special problems of harassment in the public schools, and closes with an appeal to judges and lawmakers for expanded legal protection against harassment.
In the 1990s, Marilyn Agee developed one of the most well-known amateur evangelical websites focused on the “End Times”, The Bible Prophecy Corner. Around the same time, Lambert Dolphin, a retired Stanford physicist, started the website Lambert’s Library to discuss with others online how to experience the divine. While Marilyn and Lambert did not initially correspond directly, they have shared several correspondents in common. Even as early as 1999 it was clear that they were members of the same online network of Christians, a virtual church built around those who embraced a common ideology. Digital Jesus documents how such like-minded individuals created a large web of religious communication on the Internet, in essence developing a new type of new religious movement—one without a central leader or institution. Based on over a decade of interaction with figures both large and small within this community, Robert Glenn Howard offers the first sustained ethnographic account of the movement as well as a realistic and pragmatic view of how new communication technologies can both empower and disempower the individuals who use them. By tracing the group’s origins back to the email lists and “Usenet” groups of the 1980s up to the online forums of today, Digital Jesus also serves as a succinct history of the development of online group communications.
Diasporic Africa presents the most recent research on the history and experiences of people of African descent outside of the African continent. By incorporating Europe and North Africa as well as North America, Latin America, and the Caribbean, this reader shifts the discourse on the African diaspora away from its focus solely on the Americas, underscoring the fact that much of the movement of people of African descent took place in Old World contexts. This broader view allows for a more comprehensive approach to the study of the African diaspora.The volume provides an overview of African diaspora studies and features as a major concern a rigorous interrogation of «identity.» Other primary themes include contributions to western civilization, from religion, music, and sports to agricultural production and medicine, as well as the way in which our understanding of the African diaspora fits into larger studies of transnational phenomena.
Destructive Messages argues that hate speech is dangerous not only when it poses an immediate threat of harm. It is also dangerous when it is systematically developed over time, becoming part of a culturally acceptable dialogue which can foster the persecution of minorities.Tsesis traces a causal link between racist and biased rhetoric and injustices like genocide and slavery. He shows that hate speech and propaganda, when left unregulated, can weave animosity into the social fabric to such a great extent that it can cultivate an environment supportive of the commission of hate crimes. Tsesis uses historical examples to illuminate the central role racist speech played in encouraging attitudes that led to human rights violations against German Jews, Native Americans, and African Americans, and also discusses the dangers posed by hate speech spread on the Internet today. He also offers an examination of the psychology of scapegoating. Destructive Messages argues that when hate speech is systematically developed over time it poses an even greater threat than when it creates an immediate clear and present danger. Tsesis offers concrete suggestions concerning how to reform current law in order to protect the rights of all citizens.
As the principles and practices of democracy continue to spread ever more widely, it is hard to imagine a corner of the globe into which they will not eventually penetrate. But the euphoria of democratic revolutions is typically short-lived, and usually followed by disgruntlement and even cynicism about the actual operation of democratic institutions. It is widely accepted that democracy is a good thing. However democrats have much work to do in improving the performance of democratic institutions. The essays in this volume focus on this difficult and vital challenge: how can we improve the design of democratic institutions? How can public deliberation in democracies be enhanced? How can elections be reformed so as to dampen the excessive influence of special interests, especially those with money? How can democratic institutions be reformed so they can deal with issues that transcend the boundaries of the nation-state? And finally, how can democratic practices better take account of the internal plurality of societies that are ethnically or otherwise divided? The contributors, including such leading scholars as Vicki L. Ruiz, Jennifer Scanlon, and Miriam Formanek-Brunell, examine myriad ways in which a variety of discourses and activities from popular girls' magazines and advertisements to babysitting and the Girl Scouts help form girls' experiences of what it means to be a girl, and later a woman, in our society. The essays address such topics as board games and the socialization of adolescent girls, dolls and political ideologies, Nancy Drew and the Filipina American experience, the queering of girls' detective fiction, and female juvenile delinquency to demonstrate how cultural discourses shape both the young and teenage girl in America. Although girls' culture has until now received comparatively little attention from scholars, this work confirms that understanding the culture of girls is essential to understanding how gender works in our society. Making a significant contribution to a long-neglected area of social and cultural inquiry, Delinquents and Debutantes will be of central interest to those in women's studies, American studies, history, literature, and cultural studies.
Womanist approaches to the study of religion and society have contributed much to our understanding of Black religious life, activism, and women's liberation. Deeper Shades of Purple explores the achievements of this movement over the past two decades and evaluates some of the leading voices and different perspectives within this burgeoning field. Deeper Shades of Purple brings together a who's who of scholars in the study of Black women and religion who view their scholarship through a womanist critical lens. The contributors revisit Alice Walker's definition of womanism for its viability for the approaches to discourses in religion of Black women scholars. The year was 1969. In a Chicago courthouse, David Dellinger, one of the Chicago Eight, stood trial for conspiring to disrupt the National Democratic Convention. Dellinger, a long-time but relatively unknown activist, was suddenly, at fifty-three, catapulted into the limelight for his part in this intense courtroom drama. From obscurity to leader of the antiwar movement, David Dellinger is the first full biography of a man who bridged the gap between the Old Left and the New Left. Born in 1915 in the upscale Boston suburb of Wakefield to privilege, Dellinger attended Yale during the Depression, where he became an ardent pacifist and antiwar activist. Rejecting his parents’ affluent lifestyle, he endured lengthy prison sentences as a conscientious objector to World War II and created a commune in northern New Jersey in the 1940s, a prototype for those to follow twenty years later.His instrumental role in the creation of Liberation magazine in 1956 launched him onto the national stage. Writing regular essays for the influential radical monthly on the arms race and the Civil Rights movement, he earned an audience among the New Left radicals. As anti-Vietnam sentiment grew, he became, in Abbie Hoffman’s words, the father of the antiwar movement and the architect of the 1968 demonstrations in Chicago. He remained active in anti-war causes until his death on May 25, 2004 at age 88.Vilified by critics and glorified by supporters, Dellinger was a man of contradictions: a rigid Ghandian who nonetheless supported violent revolutionary movements; a radical thinker and gifted writer forced to work as a baker to feed his large family; and a charismatic leader who taught his followers to distrust all leaders.
